RR 013-2025: Bagong Gabay sa Tax Incentives Para sa Training at Tulong sa Edukasyon

Kung nagbibigay ka ng training o suporta sa public schools, may legal kang pwedeng ibawas sa tax mo. Alamin kung paano mo ito magagamit.

Part 1: Bakit May Ganitong Rule

Ayaw ng BIR na puro penalty ang dahilan ng pagbayad ng tax.
Gusto rin nilang i-reward ang mga business na tumutulong sa edukasyon at trabaho ng mga Pilipino.

Kaya ginawa ang RR 013-2025 — para bigyan ng tax deductions ang mga negosyo na:

  • May direct labor workers
  • May certified training programs
  • Nagdo-donate sa public schools o TESDA

 

Part 2: Sino ang Qualified

Option 1: May Direct Labor Ka
Ito yung mga empleyado na gumagawa talaga ng produkto o service ng business mo.

Pwede:
• Factory workers
• Welders
• Cooks
• Electricians
• Technicians

Hindi kasama:
• Admin
• Bookkeepers
• HR
• Sales
• Accounting staff

Bawas:
Pwede kang mag-claim ng 50% additional deduction sa sweldo nila.
Halimbawa:
Kung ₱1,000,000 ang sweldo ng direct labor mo, pwede mong ibawas ang ₱1,500,000 sa taxable income mo.

Option 2: May Certified Training Ka

Kung may in-house training ka para sa staff mo at certified ito ng TESDA, CHED, or DepEd:

  • Pwede mong ibawas ang buong training expense
  • Dapat ang training ay listed sa Strategic Investment Priority Plan (SIPP)
  • Kailangan ng certificate at training records

Option 3: Nag-donate Ka sa School o TESDA

Kung nagbigay ka ng:

  • Tools
  • Equipment
  • Services (like training or software access)

Pwede mo rin itong i-claim bilang tax-deductible donation.

Value na pwede i-claim:
• Fair market value
• Book value
• O agreed amount — kung alin ang mas mababa

 

Part 3: Anong Gagawin Para Ma-Claim

Sa pag-file ng ITR:

  • I-report sa Special Allowable Itemized Deductions
  • Piliin ang legal basis: • RA 8525 para sa donation
    • RA 12063 para sa training
    • Section 294(C)(2) or (4) ng Tax Code para sa labor

Isang claim lang per expense.
Hindi pwede gamitin ang parehong resibo sa ibang tax law like CREATE.

 

Part 4: Requirements na Kailangan Mo Ihanda

  • Sworn Declaration ng business owner
    • Payroll records para sa direct labor
    • TESDA / CHED / DepEd certificate para sa training
    • Donation agreement at valuation kung donation ang claim mo

 

Part 5: Reminders from BIR

  • Pwede kang ma-audit, kaya keep your records for 3 years
  • Government agencies like TESDA need to submit a master list sa BIR every quarter
  • Kung may pending application ka before February 20, 2025, automatic approved yan — basta kumpleto at qualified ka

 

Tandaan Mo Ito:

RR 013-2025 = HIRE. TRAIN. GIVE.
Tatlong paraan para makatulong ka na, legal ka pang makabawas sa binabayaran mong tax.

Ikaw Naman:

  • May direct labor ka ba ngayon?
    • May training ba kayo na pwedeng ipa-certify?
    • Nakatulong ka na ba sa public school o TESDA?

Kung oo, baka may tax benefit ka na — hindi mo pa lang ginagamit.
